Forum rules
This section explains the guidelines for participating in the Cubeware Forum, the rights and responsibilities of all members, as well as the general terms of usage.
Threads, posts and attachments
Choose an appropriate headline
Please always choose an appropriate headline when you create a new thread (chapter) or post (entry). Please try to describe your question or problem in the headline and avoid general words like ‘Help!’. Threads with these types of headlines rarely receive visitors – or responses.
No double postings
Our moderators will delete all double postings – so please do not cause unnecessary work for them or yourself. If you have created a thread in the wrong forum by accident, the moderator will move it into the correct forum.
Giving feedback
Please choose the proper tone when giving your feedback in a forum. Whenever you add a question, please give your feedback when someone answers it or solves your problem.
Content of posts
You are responsible for all content which you publish. In addition, you must confirm that you have not published any copyrighted content in our forum. In general, the following content is forbidden or unwelcome:
- All obscene, defamatory, pornographic or other content that is liable to prosecution
- All content that is protected by trademarks or copyrights
- E-mail addresses
- Song texts
- Personal information such as telephone numbers, addresses, etc. (Please only exchange this information in private messages.)
- Other unacceptable posts that violate current laws, good conduct or the rules of this forum
The administrators reserve the right to delete, move or edit posts that do not conform with these guidelines at any time and without providing prior notice to the author.
Images, graphics and attachments
You must observe the current laws regarding property rights when using images and attachments. You alone are responsible for all content (graphics, images or attachments) which you produce and must confirm that you either have the right to use the images or attachments prior to publishing them. If you are uncertain, you must create a link to the respective graphic or file instead.
You may not, however, create direct links to images or files on other servers (i.e. traffic theft) or embed a photo as a hotlink. This is only permissible if you personally own the server or webspace in question or it stems from a Web site in which this is explicitly allowed (e.g. Click Smilies, ImageShack or another image hosting provider).
Rights and responsibilities
Private messages (PMs)
Each member has the right to exchange private messages (PM). Any violations of this function will result in its suspension. Members who want to show that another member has violated the forum rules, however, may forward the PM in question to the moderator or administrator. You may not:
- Forward PMs to third parties (see exception above)
- Post PMs or parts of them on the public forum
- Misuse PMs for marketing purposes
- Abuse PMs for illegal purposes
Nickname (user name)
Since nicknames cannot be changed after the initial registration, please choose them wisely. Please also note that the administrators will change or delete any nicknames that contain:
- Domain names or Internet addresses
- E-mail addresses
- Trademarks
- Obnoxious language
Nicknames which could be confused with that of another forum member are also prohibited.
Links
You may not create links that:
- Lead to illegal content
- Are attached to a referrer
- Refer to scams of all kinds
- Breach current laws
- Generate profit through clicks
- Refer to YouTube, MyVideo or other video platforms
- Are otherwise unacceptable
Intellectual property rights
- Each member maintains the intellectual property rights for his or her posts. By creating a post, the author transfers the non-revocable usage rights for each entry to the forum. Cubeware maintains the right to use these posts even after a member has voluntarily or involuntarily left the forum.
- Posts from moderators are property of the forum and can be used as deemed fit by the administrator. This also applies when a moderator has left the forum.
- Members may not post content from third-party Web sites if it goes beyond the character of a quote.
- Reports or news from industry portals (e.g. heise.de) are strictly prohibited. In this case, please create a link to the respective online offerings.
Moderators
The forum administrator can add or remove moderators from the forum. Moderators are forum members with the additional rights to:
- Move, edit, delete or close threads. Moderators do not have to explain or justify these actions to the respective thread authors. However, they do have to justify their actions and decisions to the administrator.
- Notify members with regards to observing forum rules
- Mediate heated discussions
Property rights
The administrators (or the moderators serving as a proxy) reserve the right to warn, block or delete users who violate these rules of usage. The administrators are entitled to practice virtual property rights in this forum. These rights do not only refer to the nicknames but also the individuals behind them.
Based on an 25 August 2000 decision from the Appellate Court, Cologne (Az. 19 U 2/00, CuR 2000, 843)
Member support
Due to the sheer number of posts and members, the moderators and administrators cannot always immediately identify all violations of the forum rules. To avoid any damages to the forum, operator or domain owner, we encourage all members to immediately report any unidentified violations to infocenter@cubeware.de. Any reports of violations should not be viewed as ‘snitching’ but rather as a self-monitoring function of the forum community.
Deleting an account
Administrators have the right to delete an account when:
- A member has repeatedly violated the forum rules
- A member wishes to be removed. The account will only be deleted if the member sends a private message asking the administrators to remove the account. The administrators will not respond to e-mail inquiries of this kind.
Banning members
The administrators can ban members from the forum if they repeatedly violate forum rules despite multiple warnings, provoke fellow members or cause other disturbances. This ban can either be valid permanently or for a certain time frame in which case it serves as a warning. The following rules apply:
- If a user has been banned permanently, the administrator will delete the account. The banned user is not allowed to log in using a new account.
- Users who have been banned for a limited time can keep their accounts and participate in the forum provided that they agree to abide by the forum rules from that point forward.
Other situations
If a situation occurs that was not previously addressed here, the moderators or the administrator will make a decision on an individual basis.
Changes to the rules
Cubeware reserves the right to add new or extend existing rules. Should any of these rules not meet a member’s expectations, he or she should directly contact the administrators who will delete the respective account immediately.
